Elijah Blue Allman Conservatorship Case Delayed as Jurisdiction Questions Emerge

Cher's effort to place her son, Elijah Blue Allman, under a conservatorship has entered another complicated phase after a California judge postponed the case and raised questions about whether the state even has the legal authority to decide it.

The latest court hearing took place on Thursday, with Elijah appearing by video from a locked psychiatric hospital in New Hampshire, where he is currently receiving treatment. The hearing ended without a ruling, and the conservatorship proceedings were delayed until September 1.

Court Questions California's Authority

One of the biggest issues discussed during the hearing was whether California courts still have jurisdiction over Elijah's case.

According to the court investigator's report, Elijah told officials he does not plan to return to California after leaving the psychiatric hospital. Judge Jessica A. Uzcategui noted that he could remain in the New Hampshire facility for as long as 18 months. Even after that, he may be transferred to another treatment center or returned to a New Hampshire jail while criminal charges against him continue.

Because of those circumstances, the judge questioned whether California remains the proper place to handle the conservatorship.

The judge ordered Cher's attorney, Justin Gold, to submit a legal brief addressing the jurisdiction issue by July 16.

Cher first sought a conservatorship over Elijah in late 2023.

Elijah's half-brother, musician Devon Allman, submitted a statement supporting the conservatorship.

He wrote that he believes Elijah is currently unable to safely manage his own life or finances.
