During a hearing on Aug. 14, the judge said Eaton acted “with full knowledge of the vulnerability” when he shared the video online, describing the post as a personal attack. Eaton is prohibited from posting additional videos of Paul, and the judge advised that the earlier video be removed from social media.
Eaton posted the video on July 9. The footage showed Paul arguing with Mortensen, who was filming. Mortensen accused Paul of previously assaulting him and said he was recording the encounter so she could not deny her alleged behavior. Paul later filed a civil stalking case against Eaton. A judge granted an initial stalking injunction on July 15, finding that “stalking has occurred.”
The case comes amid an ongoing custody dispute between Paul and Mortensen, who have each made allegations of domestic violence. Protective orders sought by both parties were mutually granted for three years in April.
Paul was also involved in a 2023 domestic violence case involving Mortensen. She was accused of throwing metal chairs at him while her daughter was present. Earlier this month, a judge ruled that Paul had completed her probation under a plea agreement and reduced her aggravated assault felony charge to a Class A misdemeanor.
Separately, Utah’s Division of Child and Family Services has asked a juvenile court to determine whether Paul’s three children are abused, neglected or dependent and to order protective supervision. Paul has two children with her former husband, Tate Paul, and a son with Mortensen.
