A grand jury returned the indictment Thursday, Sept. 3, according to court records. Biermann faces charges of aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery against a child under 16.
The charges stem from an alleged incident on April 23, 2026.
Biermann was arrested Aug. 17 in Alpharetta, Georgia, and taken into custody at the Metro Regional Youth Detention Center in Atlanta. He remains in custody and is scheduled to appear in court Sept. 9.
Zolciak has denied the allegations against her son. In a statement to Us Weekly following his arrest, she said Biermann “categorically denies” having any involvement with the woman or the alleged conduct.
Zolciak also said her son voluntarily took a polygraph examination and passed. She added that an examination found no DNA belonging to him.
“Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence,” Zolciak said, while emphasizing that people should not be publicly condemned based solely on an accusation.
Biermann Jr. is one of six children shared by Zolciak and Biermann. The couple also has sons Kash, 14, and twins Kaia and Kane, 12. Biermann adopted Zolciak’s daughters Ariana and Brielle from a previous relationship.
Zolciak and Biermann have been involved in a contentious divorce since first filing in April 2023. Biermann filed for divorce again in August 2023 after the couple briefly attempted to reconcile.
The former couple have also faced disputes over custody of their younger children. In May, a judge granted Biermann primary physical custody after he alleged that Zolciak was “unstable and unfit.” They continue to share joint legal custody.
In June, Zolciak filed a motion seeking an emergency hearing, alleging that the children were at risk of mental and physical abuse while in Biermann’s care. The status of that motion was not immediately known.
The criminal allegations against Biermann Jr. remain allegations, and he has not been convicted of the charges.
