Biermann’s attorney, Jason B. Sheffield, filed a request Wednesday in Fulton County Superior Court seeking a bond hearing. Biermann has been held at Atlanta’s Metro Regional Youth Detention Center since his Aug. 17 arrest on felony charges of aggravated sodomy and aggravated sexual battery.
In the filing, Sheffield described Biermann as a student in good standing with strong academics and significant involvement in football and community activities. The attorney said Biermann has received college scholarship offers for his athletic ability and has strong ties to his family, school and community.
Sheffield also said Biermann voluntarily took a polygraph examination and that the results showed no deception when he answered two questions related to the allegations. The attorney said Biermann has not attempted to flee, intimidate witnesses or interfere with the case.
The charges stem from an alleged April incident at a Life Time fitness center in Alpharetta, Georgia. A female classmate accused Biermann of forcing her to engage in sexual acts in a co-ed sauna despite her objections.
The alleged victim was examined at Wellstar North Fulton Medical Center the following day. According to the filing cited by Page Six, no male DNA was found in samples from her mouth or vagina.
Biermann has denied the allegations through his attorney. Sheffield said his client is “presumed innocent” and maintains that he is innocent.
Sheffield has also asked the court to seal future case developments and close proceedings to the public, citing the privacy and fair-trial rights of the juveniles involved. He said extensive social media and media coverage had created additional difficulties for the children involved.
Zolciak, 48, has publicly defended her son and criticized what she called “reckless and deeply troubling” allegations. She has warned that false accusations can harm both those accused and genuine survivors of sexual assault.
The court will determine whether Biermann receives a bond hearing and whether he can be released under conditions while the case proceeds.
